curach bhán publications – im folgenden CBP – führt Ihre Bestellungen auf der Grundlage der nachfolgenden Allgemeinen Geschäftsbedingungen (AGB) durch. Es gelten die zum Zeitpunkt Ihrer Bestellung in unserem Dienst bereitgehaltenen Bedingungen. Sie können den Text als PDF Datei auf Ihren Computer herunterladen oder ausdrucken.
Von diesen Bedingungen abweichende Regelungen erkennen wir nicht an, es sei denn, sie werden von uns schriftlich bestätigt.

Vereinbarungen mit Autoren über Druck und/oder Gestaltung von Büchern werden gesondert getroffen.
Bitte schicken Sie uns Manuskripte oder Dateien nur nach Absprache zu.
Für unaufgefordert eingesandte Manuscripte, Dateien, etc. übernehmen keine Haftung.

§ 1 Vertragsabschluß

1) Unsere Angaben zu Waren und Preisen im Rahmen des Bestellvorgangs sind unverbindlich. Der Kaufvertrag über den oder die von Ihnen ausgewählten Artikel wird geschlossen, wenn wir Ihre Bestellung durch die Mitteilung über die Auslieferung bzw. Lieferung der Ware annehmen. Die Bestätigung des Eingangs Ihrer Bestellung bewirkt noch keinen Vertragsschluss.

2) Prüfen Sie die Bestätigung auf offensichtliche Schreib- und Rechenfehler sowie auf Abweichungen zwischen Bestellung, Bestätigung und Lieferung. Sie sind verpflichtet, uns solche Unstimmigkeiten unverzüglich mitzuteilen. Wenn Sie oder wir wegen einer Unstimmigkeit die Rückabwicklung verlangen, dann öffnen Sie die Ware bitte nicht weiter. Anderenfalls müssen Sie den dadurch entstehenden Wertverlust tragen, soweit das Öffnen der Ware nicht erforderlich war, um die Abweichung festzustellen. Senden Sie die Ware an unsere auf dem Lieferschein genannte Anschrift zurück. Die Kosten der Rücksendung bzw. Abholung werden von uns getragen, wenn Sie die Unstimmigkeit nicht vor Lieferung erkennen und uns rechtzeitig mitteilen konnten.

§ 2 Widerrufsrecht

1) Sie haben das Recht, den Kaufvertrag innerhalb von 14 Tagen ab Erhalt der Ware zu widerrufen.

Die Frist beginnt mit Eingang der Ware und nicht vor Erhalt dieser Belehrung.

Zur Wahrung dieser Frist genügt die rechtzeitige Absendung des Widerrufs oder die Rücksendung der Ware. Sie dürfen Bücher zur Prüfung der Fehlerfreiheit aus der Verpackung nehmen und durchblättern oder lesen. Bei einer darüber hinausgehenden Benutzung behalten wir uns aber vor, Ihnen die Wertminderung und den Wert der Nutzung zu berechnen.

2) Den Widerruf können Sie schriftlich oder auf einem anderen dauerhaften Datenträger, per E-Mail oder durch einfache Rücksendung der Ware erklären. Der Widerruf ist an folgende Anschrift zu richten:

3) Durch den rechtzeitigen Widerruf sind Sie nicht mehr an den Vertrag mit CBP gebunden. CBP erstattet Ihnen den schon gezahlten Kaufpreis – gegebenenfalls abzüglich einer Wertminderung – zurück. Sie sind zur Rücksendung der Ware verpflichtet. Bei einem Bestellwert bis zu einem Betrag von 40,00 Euro sind die Rücksendekosten im Falle des Widerrufs von Ihnen zu tragen. Bei einem höheren Warenwert trägt CBP die Rücksendekosten.

§ 3 Lieferung

1) Bestellungen liefern wir an Postanschriften weltweit.

2) Es fallen unter Umständen Versandkosten an, die Ihnen noch vor Abschluss Ihrer Bestellung zur Bestätigung angezeigt werden.

3) Leistungsort ist das Auslieferungslager unseres Logistikpartners. Wir liefern in der Regel innerhalb von drei Werktagen. Der Lieferzeitpunkt kann sich in besonderen Fällen angemessen verlängern.

4) Wir sind zu Teillieferungen berechtigt. Wenn Sie an einer Teillieferung kein Interesse haben, dann öffnen Sie die Ware nicht weiter, bis die restliche Lieferung eingetroffen ist. Wenn die Ware von Ihnen weiter geöffnet wurde, dann müssen Sie im Falle eines Rücktritts nach Ablauf der Widerrufsfrist den dadurch entstehenden Wertverlust tragen. Bei Teillieferungen tragen wir die dadurch entstehenden zusätzlichen Versandkosten.

§ 4a Zahlungsbedingungen: Firmenkunden

1) Die gelieferte Ware verbleibt bis zur vollständigen Zahlung in unserem Eigentum. Die erste Lieferung an Neukunden erfolgt nur gegen Vorauszahlung mit 2% Skonto. CBP ist berechtigt, vom Vertrag zurückzutreten, wenn Sie mit der Zahlung in Verzug kommen.

2) Wir können nur die im Rahmen der Bestellung angebotenen Zahlungsweisen akzeptieren. Für den Fall der Rückgabe oder Nichteinlösung einer Lastschrift ermächtigen Sie Ihre Bank hiermit unwiderruflich, uns Ihren Namen und die aktuelle Anschrift mitzuteilen.

3) Wenn Sie trotz Mahnung und Fristsetzung in Zahlungsverzug geraten, sind wir zur Berechnung von Verzugszinsen in Höhe von 5% über Basiszinssatz der Europäischen Zentralbank berechtigt, soweit kein geringerer Schaden nachgewiesen wird.

§ 4b Zahlungsbedingungen: Privatkunden

1) Die Auslieferung für Kunden aus Deutschland erfolgt gegen Vorauszahlung des Rechnungsbetrages auf unser Firmenkonto oder Nutzung unseres PayPal Kontos.

2) Die Auslieferung für Kunden aus dem Ausland erfolgt aus Sicherheitsgründen in beiderseitigem Interesse ausschließlich über unser PayPal Konto.

3) Wir können nur die im Rahmen der Bestellung angebotenen Zahlungsweisen akzeptieren. Für den Fall der Rückgabe oder Nichteinlösung einer Lastschrift ermächtigen Sie Ihre Bank hiermit unwiderruflich, uns Ihren Namen und die aktuelle Anschrift mitzuteilen.

§ 5 Gewährleistung und Haftung

1) Wenn Sie uns Mängel an gelieferter Ware belegen, werden wir in angemessener Zeit entweder für Ersatzlieferung oder Beseitigung der Mängel sorgen. Gelingt uns dies nicht, haben Sie nach Ihrer Wahl das Recht auf Rückgängigmachung des Kaufs oder Herabsetzung des Kaufpreises.

2) Wir haften für verschuldete Schäden bei der Verletzung wesentlicher vertraglicher Hauptpflichten (Kardinalpflichten) oder beim Fehlen zugesicherter Eigenschaften. Darüber hinaus haften wir – gleich aus welchem Rechtsgrund – nur für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, nach dem Produkthaftungsgesetz oder wenn der Schaden durch uns oder unsere Erfüllungsgehilfen grob fahrlässig oder vorsätzlich verursacht wurde.

3) Wir haften im Falle der leicht fahrlässigen Verletzung einer wesentlichen vertraglichen Hauptpflicht höchstens bis zum typischerweise vorhersehbaren Schaden, der in der Regel den Kaufpreis der bestellten Ware nicht überschreitet. Die Haftung bei allen leicht fahrlässig verursachten Schäden ist auf Schäden an der bestellten Ware beschränkt.

§ 6 Verschiedenes

1) Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts, auch wenn aus dem Ausland bestellt oder in das Ausland geliefert wird. Wenn Sie Ihren Wohnsitz oder gewöhnlichen Aufenthalt im Ausland haben, ist Berlin Gerichtsstand für alle Ansprüche im Zusammenhang mit Ihrer Bestellung. Wir sind berechtigt, auch an Ihrem allgemeinen Gerichtsstand zu klagen.

2) Das Recht zur Aufrechnung oder Minderung steht Ihnen nur zu, wenn Ihre Gegenansprüche rechtskräftig festgestellt wurden oder wir diese schriftlich anerkannt haben. Zur Zurückbehaltung sind Sie nur befugt, soweit die Ansprüche auf dem gleichen Vertragsverhältnis beruhen.

3) Sollte ein nicht wesentlicher Teil eines Vertrages unter diesen Bedingungen unwirksam sein oder werden, so wird die Wirksamkeit des Vertrages im übrigen davon nicht berührt.

The contract between us

After you have confirmed your order we will send you an email summarising each order you have placed.
After reconfirmation your order will be packaged and is about to be dispatched to you.

We will await your payment to our paypal account or bank account with the total cost of the items being sent.
Your order will be dispatched immedeately after confirmation of your payment.

Contracts formed between curach bhán publications and you as a result of using this site shall be governed in all respects by German law and you hereby submit to the non-exclusive jurisdiction of the German courts.

Completion of the contract between you and curach bhán publications will take place on dispatch to you of the products ordered.
This will be deemed to be our acceptance of your offer and to have been effectively communicated to you.

Please note that some of our processes are manual and errors can arise. We carry out frequent checks to detect any errors. If they do occur, we will act immediately to minimise inconvenience and disappointment that may be caused. We reserve the right to cancel any order where obvious errors in pricing or product description have occurred.

curach bhán publications aims to provide outstanding customer service. If you have any complaint about the service you have received from us please contact our Customer Services Team at support@curach-bhan.com.

Availability

Our availability information is updated regularly but it is possible that in some instances a title may become unavailable between updates.

We will make every reasonable effort to deliver the products you have ordered within the delivery timeframe displayed on the product page at the time of ordering. If this is not possible your order will be dispatched as soon as goods become available to us. Our policy is to cancel orders if we have been unable to supply goods within 60 days, with the exception of products that have not yet been published or released.

The dispatch and delivery times given are approximate and delays can sometimes occur. You will receive an email as soon as your order is dispatched.

All delivery times quoted on this website are estimates only, these times are based on working days (Monday to Friday, without Bank holydays).

You will become the owner of the products you have ordered when the products have been dispatched to you.

Restrictions

By creating an account you confirm that you are aged 18 or over.

In placing an order you confirm that you are aware of any age restrictions on these products and assert that you are old enough to purchase them.

In some instances we may decline to deliver parcels to PO addresses. We will contact you if we consider the PO address to be a problem.

All orders are made subject to these Terms and Conditions.

Prices and VAT

Prices shown on this site include VAT, where and to the extent that VAT is required to be applied to the product under German VAT law. Delivery charges are extra.

Although we make every effort to ensure the prices on the website are correct, mistakes may sometimes be made. If we discover a mistake in the price of the products you have ordered prior to their dispatch, we will tell you and give you the option of either reconfirming your order at the correct price or canceling your order. If we are unable to contact you or we receive no reply from you we will cancel your order.

curach bhán publications reserve the right to change prices listed without notice. All orders for products are subject to availability and curach bhán publications reserves the right to refuse to supply to any individual or company.

Cancellation rights

It is advisable that you cancel any unwanted orders via the "My Account" link on the website, or by contacting our Customer Services team directly on ++49 - 30 - 450 857 38, before the products are invoiced and dispatched. Requests for cancellations sent via email (to daniel@curach-bhan.com) may not be actioned immediately which may result in the order being dispatched.

You can also cancel your order within 14 working days after the date of delivery by contacting our customer service team or by calling ++49 - 30 - 450 857 38, where one of our customer service team will be able to help. Please have your order number ready when you call.

If you cancel your order within 14 working days after the date of delivery you must return the unwanted products to us unused and in their original packaging within thirty (30) days of delivery. Provided you return the unwanted products unused and in the original packaging within thirty days of delivery we will credit your payment card with the cost of the unwanted product and our delivery charges.

You have no right to cancel your order in accordance with this condition if the products you have ordered are: periodical(s) or magazine(s); audio; video or DVD recordings; or computer software where the holographic seal and/or shrink-wrap has been unsealed by you.

Returns and credits

Products not obtained for re-sale purposes can be returned under the following conditions:

The item must be returned within 30 days of receipt.
Returns of orders less than 40 Euro worth are at your risk and at your cost
Books must be in unused (re-saleable) condition. You have the right to open the seal and look into the book, but we may charge you for damages to the book.
CDs, DVDs and Video Games must have their holographic seal or shrink-wrap intact
Computer games and software which requires a unique licence cannot be returned unless they are faulty
Magazine gift packs and Experience gift packs can only be returned providing that they are in their original condition and have not been activated
Any other item must be returned in new condition with its original packing and accessories
Products may be returned:

By post in accordance with the following procedure:
Repackage the products securely and send the products together with the reason for return, the invoice number, your e-mail address or telephone number and instructions as to whether you would like a refund or a replacement. You will find the Returns address on the paperwork that arrives with your order.

Returns by post are made at your risk. We recommend that you use an insured registered mail service as returns not received by us cannot be credited to you.

Refunds will be credited to your PayPal account. Refunds will not be paid in cash.

Replacement Goods

If you receive an incorrect or damaged item from curach bhán publications please return it to us within 14 days of receipt for a full refund or exchange.

In the event that you receive a defective item please ensure that you keep any warranty information relating to the product.

Promotions

All promotions are subject to availability.

Discounting

Discounts shown against the previous selling price. Due to frequent changes to online prices and promotions you will always be charged the price as confirmed at the time of placing your order.

Multi-Buys

If you choose to purchase a product from a Multi-buy offer, but do not purchase enough products to qualify for the special discount, the product will be charged at the normal price.

When this is the case you will see the following message "You have items in your basket which qualify for a Multi-buy offer, but you do not currently have enough items to activate this offer".

Qualifying products will be marked in your basket. The relevant amount of extra discount will be applied automatically to your total basket price (The cheapest item will be discounted).

Should a Multi-buy item be cancelled from your order the total cost of the order will be recalculated to reflect that your purchase no longer qualifies for the Multi-buy discount.

Payment Details

We only accept payment by PayPal (and subsequently the credit cards accepted by PayPal) or direct money transfer to our bank account.

All product prices and delivery charges are shown in Euro (€), US-Dollar (US$), Canadian Dollar (CDN$), Australian Dollar (AUS$), or British Pound (£) .

Before accepting your order we will carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to cover the cost of the transaction.
No payment is debited from your card during this pre-authorisation check.

Your PayPal account will only be charged when the items in your order are ready to be dispatched, and will not be debited for items in your order that have not been dispatched.

Incorrect Goods
Where you are returning a product due to an error by curach bhán publications we will refund your return postage costs to your payment card.

Unwanted Goods

Your unwanted products have to be returned to curach bhán publications to the returns address provided on the paperwork sent with your order.

Goods Lost in Transit

For deliveries to any address please allow 14 working days from date of dispatch. If after 14 days your goods have not arrived please click here to contact our Customer Service team or call our Customer Service team on ++49 - 30 - 450 857 38.

Limitation of Liability

We will not be liable to you:
For any loss of profit, administrative inconvenience, disappointment, or indirect or consequential loss or damage arising out of any problem in relation to the products you ordered which was not within our reasonable contemplation as a probable result of a breach of contract on our part at the time that our contract with you was concluded, or where performance of any obligations to you is prevented, frustrated or impeded by any circumstance or cause beyond our reasonable control.

Severability

If any part of these terms and conditions is found to be unenforceable as a matter of law, the enforceability of any other part of these terms and conditions will not be affected.

Governing Law

These terms and conditions and any contract between us shall be governed by and interpreted in accordance with German law and the German courts shall have jurisdiction over any disputes between us.

Statutory Rights

These terms and conditions are in addition to your statutory rights as a consumer, which remain unaffected.

Disclaimer

curach bhán publications make no representations or warranties about the accuracy, completeness or suitability for any purpose of the information contained in the documents and related graphics published in this site; or any of the products of whatever nature details of which appear on this site.
